Terms of Service
These Terms of Service ("Terms") govern your use of the Unmapped Canvas website, mobile web app and related services (the "Platform"). The Platform is operated by The Unmapped Canvas Ticketing Limited ("we", "us", "our"). By creating an account, buying a ticket (including as a guest) or using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.
These Terms should be read together with our Privacy Policy, Payment Terms, Refund & Cancellation Policy and Cookie Policy. Organizers who sell tickets are also bound by the Organizer Terms.
1. What we do - and what we do not
The Platform lets organizers list events and sell tickets, and lets attendees discover events, buy tickets and enter events. We act as a ticketing platform and payment intermediary between organizers and attendees.
We do not organize the events listed on the Platform. Each event is run by its organizer, who is responsible for the event itself: its content, venue, safety, licences and permits, start time and any changes to it. Your contract to attend an event is with the organizer; our role is to sell and deliver the ticket and handle the payment.
2. Accounts
- You must be at least 18 years old to create an account or buy a ticket. If you are under 18, a parent or guardian must make the purchase on your behalf.
- You can buy tickets as a guest without an account, in which case your ticket is delivered to the email address and phone number you give at checkout. Keep those messages: they are how you get back to your ticket.
- Give accurate information and keep your login details private. You are responsible for activity on your account. Tell us promptly if you think someone else has used it.
- Organizer accounts may need to be verified and approved by us before they can publish events.
- We may suspend or close an account, or cancel orders, if we reasonably believe it is being used for fraud, abuse or in breach of these Terms.
3. Buying tickets
- Price. The price of a ticket is set by the organizer and shown in the currency of the event, together with any taxes, before you pay. Early-bird prices apply only until the end date shown on the ticket.
- Order confirmation. Your order is confirmed when payment is confirmed. Orders paid by bank transfer stay pending until the organizer or we confirm the payment. Until then you do not have a valid ticket.
- Availability. Tickets and seats are limited. A seat you select is held only while you complete checkout. If a payment fails or is rejected, the seat is released.
- Your ticket. Your ticket is a QR code with a backup code, delivered by email, SMS and, if you have chatted with us there, WhatsApp, and available through a private link. Anyone who holds the code may be able to use it, so do not share it or post it publicly. Each ticket admits the number of people stated on it, and by default admits entry once unless the organizer allows re-entry.
- Limits. Organizers may set a maximum number of tickets per person. We may cancel orders that exceed those limits or that appear to be made by bots or for unauthorised resale.
- Lost tickets. You can open your ticket again from your account or from your confirmation email or SMS. Contact us if you cannot find it.
4. Transferring and reselling tickets
You may transfer a ticket to another person through the Platform. When the new holder accepts, your original QR code stops working and a new one is issued to them. A transfer invitation that is not accepted expires after 48 hours.
Where the organizer allows resale, you may list a ticket on the Platform's resale marketplace at or below the price limit set for that event. A platform fee and any organizer royalty are deducted from the sale price before the seller is paid. Selling tickets outside the Platform, at a price above the limit, or by way of business without the organizer's permission is not allowed, and tickets sold that way may be cancelled without refund.
5. Attending an event
The organizer's rules, the venue's rules and the law apply at the event. The organizer or venue may refuse or end entry for breach of those rules, for safety reasons, or if a ticket cannot be validated. A ticket may be refused if it has already been used, has been transferred, has been refunded, is on hold for review, or is not paid for. Gate staff may record your entry and exit through our check-in system.
6. Changes, cancellations and refunds
Events can be changed, rescheduled or cancelled by their organizers. Your rights to a refund are set out in our Refund & Cancellation Policy.
7. Acceptable use
You must not:
- use the Platform for anything unlawful, fraudulent or misleading, or to sell tickets to events that do not exist;
- use bots, scripts or other automated means to buy tickets, scrape the Platform, or place a load on it;
- try to bypass payment, ticket validation, seat selection or security, or interfere with the Platform or other users' accounts;
- copy, forge or share ticket codes in a way designed to admit more people than were paid for;
- upload content that is unlawful, infringing, hateful, or that you do not have the right to share.
8. Content and intellectual property
The Platform, its design, software and the Unmapped Canvas name and logo belong to us or our licensors. Organizers keep the rights in the event content they upload, and give us a non-exclusive licence to display it on the Platform and in our marketing of their event. You may not copy or reuse Platform content except for your own personal use of the service.
9. Third-party services
The Platform works with third parties, including payment providers (for example mobile-money operators and card processors), SMS and WhatsApp providers, email delivery, and Google Maps. Their services are governed by their own terms. We are not responsible for outages or failures of third-party services outside our control, but we will help you resolve any problem with an order.
10. Our responsibility to you
We work to keep the Platform available and accurate, but we provide it "as is" and cannot promise it will be uninterrupted or error-free. We are not responsible for an event's content, quality, safety, cancellation or change; for those, your claim is against the organizer. Nothing in these Terms limits any right you have under Kenyan consumer protection law that cannot lawfully be limited, or our liability for fraud or for death or personal injury caused by our negligence.
Subject to that, and to the extent the law allows, our total liability to you for any claim connected with a ticket purchase is limited to the amount you paid us for that ticket, and we are not liable for indirect or consequential loss.
11. Suspension and ending your account
You can stop using the Platform at any time. We may suspend or end your access if you breach these Terms or if required by law. Ending an account does not affect tickets you have already bought, or rights and obligations that arose before it ended.
12. Changes to these Terms
We may update these Terms from time to time. The date at the top of this page shows the latest version. If a change is significant we will tell you by email or on the Platform. Continuing to use the Platform after a change means you accept it.
13. Governing law and disputes
These Terms are governed by the laws of Kenya. If you have a complaint, please contact us first so we can try to resolve it. If we cannot, the courts of Kenya have jurisdiction, without affecting any right you have to bring a claim in the courts of the country where you live where the law gives you that right.
